The missing link

When we look at Darwins theory of Evolution - there is the missing link - the precise moment when man evolved from the Apes.

When we look at the Universe and look for the Universe beyond the Universe and digest the fact that we are not at the center of the Universe or for that matter even the Universe is not the center of the multitude of Universes that populate the "missing concept"? :-)

When we look at the smallest of the small - you can bet your bottom dollar you will be "string"ed along by the Quantum Physicists - there is the missing link - the God particle

When you ask someone like a Ramanujam who came up with stuff like 1729 (hardy number) etc to explain how he knows and sees what he sees - he cannot describe the same - he can only continue being himself :-)

Similarly ask any teacher the moment when a child understands to write, to read etc - that moment is the missing link and knowbody knows these mysteries.

This is all a mystery as we all think in a finite way when in reality this is in the realm of Infinite possibilities and rightly beyond the finite - in the infinite we reside - so why limit overselves with the missing link - be the missing link.

knowledge patent, a theist and an atheist

Faith is the power that takes one to a glimpse of the soul - is that soul cancer ridden? its only the temporary body that is afflicted by all the ravages of age. the problem with the above article and those who "lose faith" in something is because they are looking at:
i) external results and
ii) joy from mantras
both are erroneous - joy is there every moment - either you are joy or you are not.

Glad tidings from mantras is something that the brahmins of the past resorted to as a money making methodology - thats why knowledge deserted them and we are today left with meaningless rituals and not the treasure trove of knowledge that was handed down to them from the times of Vyasa. the knowledge per se was much older and maybe vyasa was the first to "patent the same?"

The main argument put forth by atheists is about the violence unleashed by man in the name of religion (and still continues till date). what they forget is that religion was formed as a political tool to manage the masses of conquered lands (christianity, islam etc) and hence many of them sprouted up. whereas those religions that sprouted as a response to misuse of knowledge by the brahmins (mindless rituals) are those of the buddha(buddha), mahavira (jainism) etc.

Once a different sect/ religion is established it is all about numbers - the more followers we have the better for the kingdom of OUR god has to be the largest.

Frankly i believe the atheists would do good to read up the knowledge of vedanta which is areligious (if there is such a word) and the religious one would get out of the numbers game/rituals/practices etc and embrace the knowledge (which is what the atheists are after!!)

But the biggest truth is that each has to have FAITH in good measure that nature is only one and its preservation is the purpose of our existence which is the ultimate truth. LOVE is all there is in the end and that requires large doses of TRUST in the fellow human being.

Profession old and new

The oldest profession in the world in spite of its disproportionate share of abuse, violence and exploitation still survives and thus is a testimony to the survival factor of "human values".

Recent legislative changes in various countries with respect to the legalising or criminalising of the various forms of prostitution/ escort services/ exotic massage services etc etc have all been brushed aside by the natural path of evolution taken by the profession.

The proponents of decriminalising have this to state:

1. To provide information and guidance in hopes that the commercial sex scene is limited to consenting adults and those who choose of their own free will to engage in it.
2. If prostitution were outlawed, then it would effectively be handed to organised crime on a platter ) just as happened with liquor during Prohibition.
3. If, on the other hand, sexwork is recognised as a legitimate, honourable profession, then
there will be no market for the criminal elements, and the truly despicable aspects of the
scene such as sex slavery and trafficking will die out. Surely that is a far more desirable
goal than driving it back underground where it will then consist only of criminals and
victims? (ideal situation for politicians)

Those who want to put an end to this by passing legislation have this to say:
1. It is degrading of women
2. It exploits them and in cases where sexworkers are allowed by law to pursue their profession, there have been increased instances of underage sexworkers and exploitation.
3. Encourages men to look upon and treat women as commodities.

Personally I feel that unless the demand stops this will continue, unless women stop competing amongst themselves to get "their man" this will not stop - we dont call this prostitution but we call this "divorce due to the other woman". (expect a lot of brickbats for this but just think why a woman would pursue a man who is married? - men will fall for the slightest seduction - not all have evolved to control their carnal instincts - think before you pounce on one)

Hence the key to this rests with the woman herself - as the mother if she were to instill in every male child the feeling of respect and honour to the female of the species and not to look upon them as a commodity maybe in the next millennium we can read about this "profession" in the history books instead of "debating" the pros and cons of allowing free trade or banning it - both arguments sound hollow and reprehensible to me!!

Higher ground of lending

THINK Micro Finance (MFI) and Grameen bank of Bangladesh comes to mind. Heard of SKS? Well they have replicated the same in India and are currently making an IPO to take this concept to the Upwardly mobile Urban Indian home.

There is a lot of debate on how to justify the concept of profit in a process that is basically one arising out of philanthropy. But is it really that simplistic a view?

Let us look at the social change being re engineered here:
1. Professional lenders against moneylenders
2. RBI oversight against none for moneylenders - makes it easier for NGO's to take up cudgels against unfair lending practices something which is non existent with the money lender.
3. Chance for the rural local entrepreneur to come out of generations of poverty and maybe just maybe take a fair shot at the emerging Indian dream.
4. Avoidance of exploitation - cases of money lenders taking people as bonded labour, human trafficking, child abuse etc was common practice - this should reduce over the next decade as companies like SKS spread their wings.

Personally I do not buy IPO's but this is one issue that needs support so go out there and subscribe. India's deliverance is not in the hands of the politicians but in the people's hands and the people have spoken by making micro finance a success story till date.

What is the support that is required from the RBI/ Govt?

1. Dont interfere other than what exists in the regulations currently for oversight.
2. Keep out the blood suckers like GS/ MS/ JPM etc by not allowing recourse to refinance for these MFI's other than Federal Govt agencies like NABARD, HUDCO etc and of course the RBI.
3. A separate ombudsman in each state who will liaise through the district collector so that the MFI's are not tempted to be become the new "moneylenders"

All in all I think the financial revolution in India is starting just about now. Jai Ho..

There's nothing more permanent than a temporary tax increase

A while back when crude prices were crossing all known levels and threatening to go beyond $200/ barrel, airlines came in with a "fuel surcharge" - guess what as crude prices are now at $72 these fuel surcharges remain!!

Similarly the government brought in temporary hike in rates of certain taxes to meet "social scheme costs" - these are today a permanent fixture.

The thing that the voting public needs to remember is that there is no free lunch and that the fiscal deficits of today have to be met by revenues generated in the "FUTURE". (unless of course you live in the American state of Vermont which is the only state that is not bound by any legislation to balance its books!!)

So get used to a regime of higher taxes and consequently higher prices for all goods and services. Also get used to seeing more "vice" businesses as these are the highest revenue grossers for the government. (Ironically this reflects on the voters taste to begin with). Dont be surprised if banned substances are allowed to be legally sold as long as the govt gets its share of the pie!!

So what can you as the voter do today to change the future? Start by balancing your books. Live within your means. Borrowing should be only for a house or for ones education. Cars, holidays and other "stuff" should be separately saved for.

For those "addicted" to plastic money - start using prepaid cards with zero possibility of credit on them.

Start a signature campaign to force the government to adopt a legislation to never run a deficit until 50% of all existing debts/ obligations/ liabilities of the govt are extinguished. (For the US that would amount to close to $4-5Trillion, For India that would be close to $400Billion)

Would this make life better as we know it - I dont know - but at least our children and grandchildren wont be cursing us when the country goes bankrupt one fine day!!

Oil lessons for "nuclear" India

There is a bill in the parliament which if enacted would cap the liability of companies engaged in nuclear power to some fixed amount. For eg. in the BP gulf oil mess the liability of BP is limited to USD75Million plus the "clean up costs". The calculation that BP has been criminally liable of doing is:

cost of clean up = 75+x

loss due to a full cap (tech available with them since day 1 of oil spill) = y

now as "y > 75+x" the business decision is to "let the oil flow". Full cap is that the well is "closed" and is written off as a total loss for BP!!

Similarly in the future when a nuclear disaster were to occur the business decision will keep the "leak" going on as long as y>75+x !!

Has Mukesh been too smart here?

As the final chapters in the Mother of all brother rivalries is being written - the first para was on predictable lines. The money, muscle and connection power of the elder brother has won the day.. OR HAS IT??

The only way that RIL could deny the windfall gains to the ADAG was if the superiority of the Govt wrt the allocation and pricing is acknowledged. This was the cornerstone on which the fight was played out and the hastily convened EGom gave a rate which would reverse the windfall from ADAG to RIL. Now that the coveted status has been achieved - let us look at the implications..

RIL can never ever participate in any tender for supply of Gas as it is the government which who is the sole owner of the Gas (Based on the supreme court ruling) - That means that the NTPC tender and other such tenders are null and void just as the RNRL contract has been found incorrect by the SC. (Just to rephrase - the SC has held that the Government has the power to fix the price and also to whom the Gas will be allocated - But the corrolory that all this was managed to only deny RNRL its windfall gains is true too.)

This will result in the biggest ripoff of all times!! The combined sales to RNRL and NTPC alone would result in an additional income of some 50-60000 crore Rupees to RIL, this will of course come from the pocket of electricity consumers!! If the Government were to allow the higher price and give a subsidy for the same - this would be another PIL in the making - that money is being printed by the Govt to pay into the private coffers of a company just so that the politicians in the pay leash of the corporate can justify their existence!! This would be in contravention of all accepted norms and mores as the lower rate quoted to NTPC was the result of a Tender and any revision based on some corrupted EGom (setup at the instigation of RIL) is the most brazen form of corruption one is witnessing today!!

So the last few paras of the brothers saga will be interesting as these will depend on the road the Government takes now. They can easily ratify the contracted rates and put to rest the controversy once and for all wrt to RNRL and NTPC or THEY can choose to sully their hands furthur by revising the rates and going down the slippery slopes of corruption..wouldnt be surprised if these rates are increased before elections.

Retiring - the mirage..

Another day Another BAILOUT.

The latest is the close to a Trillion Dollar bailout of Greece. When will this madness end and when will this mortgaging of the future of kids end?

Do we as "common people" have a say in the indiscriminate and competitive "bailout" spending being practiced by our governments? In India if it is not some "stimulus package" it is some "subsidy" or some pay commission which leads to inflation.

This only means that the dream of retiring "early" is nothing more than that. All those who have been fiscally responsible in their individual lives, been disciplined in their spending are now left with assets rendered worthless by the ravages of inflation will have to come out of retirement to work again!!

This will lead to a disruption in society leading to a new social order as more people get frustrated with their lot and start blaming the system for the mess their orderly lives have been made into. The next revolution is not far off - its just a question of when and in which country.

The prime candidate for this upheaval will be where the quality of living sees the maximum drop - the irony in all this is - it is this fear which has prompted the BAILOUT in the First place!!

Talk about economic experts and Vested interests!!

Price obfuscation - EMAAR style..

Emaar MGF is the combine which is building the Games village for the Commonwealth Games. And as it turns out these flats are to be sold once the Games are over.

The brochure of Emaar is a minefield and if one is not up to the task of understanding each and every line in that you would end up paying a rate which is scandalous at best!!

Let us take the exact measurements for a 2090 Sft 3 Bedroom apartment or what we call the carpet area from their drawing available online!!

So you are being billed for 2090 sft @13250/-sft and getting only 1242.65 sft to live in actually!!

This translates into INR1.65 Cr for the actual area you live in AND
1.13 Cr for the common amenities like swimming pool etc.. (For this price one can build a swimming pool, tennis court, badminton court, table tennis table, etc etc FOR PRIVATE USE)..

Btw the other charges are:
9th floor 900 per sft
temple facing 500 per sft
parking 900000 for two cars
PLC, Regn etc (another 5-7% of TOTAL ABOVE COST)

So taking all of the above into consideration it comes to a princely 24000/- sft plus Regn of 6% so one can say a round sum of 25000/- sft ALL INCLUSIVE - so now would be buying ?

Going by the practices followed by emaar in the gulf – it would not be surprising if you are bound to them for life!! In other words, you cant extend a telephone/ electrical line – because there would be some circuit lock which will disable the system if there is any tampering etc.
A pump would be activated every time you open the tap to give you water “at a steady pace” - increasing both your water consumption and electricity cost!!

All the deceptive marketing tactics are being employed:
1. When this was launched (2-3yrs back) – it was shown as a success – we now find out that practically the entire place is up for grabs!!
2. The rate is specified in per sft basis, whereas the areas marked in the floor plan are in metre sq.
3. There is no clarity on the various “other charges” and the “maintainance charges” going forward.
4. There is no fixed procedure for the creation of a RWA and the conduct of initial elections of the same to hand over the common facility management to the owners from the developer.

If ever there was a crying need for a regulator it is in this space!! Caveat Emptor..

King of elections

There was a story that there was a credit crisis that originated in the Wild Wild West and that it took a lot of innocent bystanders in its wake. One such innocent group to be affected was the "money launders"(ML) for the political class(PC) in India. The result of the PC to not understand the problem's faced by the ML resulted in the Satyam crisis. With looming elections and no funds in sight a desperate PC declared a bounty on government contracts and the winner would be anointed the king.

As the story finally panned out the king(Raja) of the elections was born who made a tidy sum on sale of spectrum. Post the public denouncement across the board by the entire fourth estate the PC is busy undermining the value of the 3G spectrum sale so that the "free" sale by the King can be brought in context with the "price" of the 3G.

How is this to be achieved?
Step 1 - Get somebody to offer 3G at rates lower than 2G (isnt that what BSNL and MTNL - both PC controlled are offering?)
Step 2 - Make the availability of spectrum the lottery here rather than the license !!

You can be rest assured working on the above the auction prices of the 3G would be comparable to the 2G license sale just to fund an election and that would be the faits accomplis that the PC wants and all along we had a King of the elections - just that the poor fellow doesnt know it!!

Obama - sorry you cant hide behind the Bush..

It is almost prophetic that "Joe Stack" did what he did. But this was to be expected - and all presidents since the great depression who allowed the system to build into what it is today are all to blame.

If even after this citizens of countries that have irresponsible people inflating their cost of living all in the name of "managing growth" dont ACT - we are going to have more zombies electing more crooks into power and there is no point blaming the elected after all!!

If you're reading this, you're no doubt asking yourself, "Why did this have to happen?" The simple truth is that it is complicated and has been coming for a long time. The writing process, started many months ago, was intended to be therapy in the face of the looming realization that there isn't enough therapy in the world that can fix what is really broken. Needless to say, this rant could fill volumes with example after example if I would let it. I find the process of writing it frustrating, tedious, and probably pointless… especially given my gross inability to gracefully articulate my thoughts in light of the storm raging in my head. Exactly what is therapeutic about that I'm not sure, but desperate times call for desperate measures.

We are all taught as children that without laws there would be no society, only anarchy. Sadly, starting at early ages we in this country have been brainwashed to believe that, in return for our dedication and service, our government stands for justice for all. We are further brainwashed to believe that there is freedom in this place, and that we should be ready to lay our lives down for the noble principals represented by its founding fathers. Remember? One of these was "no taxation without representation". I have spent the total years of my adulthood unlearning that crap from only a few years of my childhood. These days anyone who really stands up for that principal is promptly labeled a "crackpot", traitor and worse.
While very few working people would say they haven't had their fair share of taxes (as can I), in my lifetime I can say with a great degree of certainty that there has never been a politician cast a vote on any matter with the likes of me or my interests in mind. Nor, for that matter, are they the least bit interested in me or anything I have to say.

Why is it that a handful of thugs and plunderers can commit unthinkable atrocities (and in the case of the GM executives, for scores of years) and when it's time for their gravy train to crash under the weight of their gluttony and overwhelming stupidity, the force of the full federal government has no difficulty coming to their aid within days if not hours? Yet at the same time, the joke we call the American medical system, including the drug and insurance companies, are murdering tens of thousands of people a year and stealing from the corpses and victims they cripple, and this country's leaders don't see this as important as bailing out a few of their vile, rich cronies. Yet, the political "representatives" (thieves, liars, and self-serving scumbags is far more accurate) have endless time to sit around for year after year and debate the state of the "terrible health care problem". It's clear they see no crisis as long as the dead people don't get in the way of their corporate profits rolling in.

And justice? You've got to be kidding!

How can any rational individual explain that white elephant conundrum in the middle of our tax system and, indeed, our entire legal system? Here we have a system that is, by far, too complicated for the brightest of the master scholars to understand. Yet, it mercilessly "holds accountable" its victims, claiming that they're responsible for fully complying with laws not even the experts understand. The law "requires" a signature on the bottom of a tax filing; yet no one can say truthfully that they understand what they are signing; if that's not "duress" than what is. If this is not the measure of a totalitarian regime, nothing is.

How did I get here?

My introduction to the real American nightmare starts back in the early '80s. Unfortunately after more than 16 years of school, somewhere along the line I picked up the absurd, pompous notion that I could read and understand plain English. Some friends introduced me to a group of people who were having 'tax code' readings and discussions. In particular, zeroed in on a section relating to the wonderful "exemptions" that make institutions like the vulgar, corrupt Catholic Church so incredibly wealthy. We carefully studied the law (with the help of some of the "best", high-paid, experienced tax lawyers in the business), and then began to do exactly what the "big boys" were doing (except that we weren't steeling from our congregation or lying to the government about our massive profits in the name of God). We took a great deal of care to make it all visible, following all of the rules, exactly the way the law said it was to be done.

The intent of this exercise and our efforts was to bring about a much-needed re-evaluation of the laws that allow the monsters of organized religion to make such a mockery of people who earn an honest living. However, this is where I learned that there are two "interpretations" for every law; one for the very rich, and one for the rest of us… Oh, and the monsters are the very ones making and enforcing the laws; the inquisition is still alive and well today in this country.

That little lesson in patriotism cost me $40,000+, 10 years of my life, and set my retirement plans back to 0. It made me realize for the first time that I live in a country with an ideology that is based on a total and complete lie. It also made me realize, not only how naive I had been, but also the incredible stupidity of the American public; that they buy, hook, line, and sinker, the crap about their "freedom"… and that they continue to do so with eyes closed in the face of overwhelming evidence and all that keeps happening in front of them.

Before even having to make a shaky recovery from the sting of the first lesson on what justice really means in this country (around 1984 after making my way through engineering school and still another five years of "paying my dues"), I felt I finally had to take a chance of launching my dream of becoming an independent engineer.

On the subjects of engineers and dreams of independence, I should digress somewhat to say that I'm sure that I inherited the fascination for creative problem solving from my father. I realized this at a very young age.

The significance of independence, however, came much later during my early years of college; at the age of 18 or 19 when I was living on my own as student in an apartment in Harrisburg, Pennsylvania. My neighbor was an elderly retired woman (80+ seemed ancient to me at that age) who was the widowed wife of a retired steel worker. Her husband had worked all his life in the steel mills of central Pennsylvania with promises from big business and the union that, for his 30 years of service, he would have a pension and medical care to look forward to in his retirement. Instead he was one of the thousands who got nothing because the incompetent mill management and corrupt union (not to mention the government) raided their pension funds and stole their retirement. All she had was social security to live on.

In retrospect, the situation was laughable because here I was living on peanut butter and bread (or Ritz crackers when I could afford to splurge) for months at a time. When I got to know this poor figure and heard her story I felt worse for her plight than for my own (I, after all, I thought I had everything to in front of me). I was genuinely appalled at one point, as we exchanged stories and commiserated with each other over our situations, when she in her grandmotherly fashion tried to convince me that I would be "healthier" eating cat food (like her) rather than trying to get all my substance from peanut butter and bread. I couldn't quite go there, but the impression was made. I decided that I didn't trust big business to take care of me, and that I would take responsibility for my own future and myself.

Return to the early '80s, and here I was off to a terrifying start as a 'wet-behind-the-ears' contract software engineer... and two years later, thanks to the fine backroom, midnight effort by the sleazy executives of Arthur Andersen (the very same folks who later brought us Enron and other such calamities) and an equally sleazy New York Senator (Patrick Moynihan), we saw the passage of 1986 tax reform act with its section 1706.

For you who are unfamiliar, here is the core text of the IRS Section 1706, defining the treatment of workers (such as contract engineers) for tax purposes. SEC. 1706. TREATMENT OF CERTAIN TECHNICAL PERSONNEL.

(a) IN GENERAL - Section 530 of the Revenue Act of 1978 is amended by adding at the end thereof the following new subsection:

(d) EXCEPTION. - This section shall not apply in the case of an individual who pursuant to an arrangement between the taxpayer and another person, provides services for such other person as an engineer, designer, drafter, computer programmer, systems analyst, or other similarly skilled worker engaged in a similar line of work.

(b) EFFECTIVE DATE. - The amendment made by this section shall apply to remuneration paid and services rendered after December 31, 1986.

Note:

"another person" is the client in the traditional job-shop relationship.
"taxpayer" is the recruiter, broker, agency, or job shop.
"individual", "employee", or "worker" is you.

Admittedly, you need to read the treatment to understand what it is saying but it's not very complicated. The bottom line is that they may as well have put my name right in the text of section (d). Moreover, they could only have been more blunt if they would have came out and directly declared me a criminal and non-citizen slave. Twenty years later, I still can't believe my eyes.

During 1987, I spent close to $5000 of my 'pocket change', and at least 1000 hours of my time writing, printing, and mailing to any senator, congressman, governor, or slug that might listen; none did, and they universally treated me as if I was wasting their time. I spent countless hours on the L.A. freeways driving to meetings and any and all of the disorganized professional groups who were attempting to mount a campaign against this atrocity. This, only to discover that our efforts were being easily derailed by a few moles from the brokers who were just beginning to enjoy the windfall from the new declaration of their "freedom". Oh, and don't forget, for all of the time I was spending on this, I was loosing income that I couldn't bill clients.

After months of struggling it had clearly gotten to be a futile exercise. The best we could get for all of our trouble is a pronouncement from an IRS mouthpiece that they weren't going to enforce that provision (read harass engineers and scientists). This immediately proved to be a lie, and the mere existence of the regulation began to have its impact on my bottom line; this, of course, was the intended effect.

Again, rewind my retirement plans back to 0 and shift them into idle. If I had any sense, I clearly should have left abandoned engineering and never looked back.

Instead I got busy working 100-hour workweeks. Then came the L.A. depression of the early 1990s. Our leaders decided that they didn't need the all of those extra Air Force bases they had in Southern California, so they were closed; just like that. The result was economic devastation in the region that rivaled the widely publicized Texas S&L fiasco. However, because the government caused it, no one gave a shit about all of the young families who lost their homes or street after street of boarded up houses abandoned to the wealthy loan companies who received government funds to "shore up" their windfall. Again, I lost my retirement.

Years later, after weathering a divorce and the constant struggle trying to build some momentum with my business, I find myself once again beginning to finally pick up some speed. Then came the .COM bust and the 911 nightmare. Our leaders decided that all aircraft were grounded for what seemed like an eternity; and long after that, 'special' facilities like San Francisco were on security alert for months. This made access to my customers prohibitively expensive. Ironically, after what they had done the Government came to the aid of the airlines with billions of our tax dollars … as usual they left me to rot and die while they bailed out their rich, incompetent cronies WITH MY MONEY! After these events, there went my business but not quite yet all of my retirement and savings.

By this time, I'm thinking that it might be good for a change. Bye to California, I'll try Austin for a while. So I moved, only to find out that this is a place with a highly inflated sense of self-importance and where damn little real engineering work is done. I've never experienced such a hard time finding work. The rates are 1/3 of what I was earning before the crash, because pay rates here are fixed by the three or four large companies in the area who are in collusion to drive down prices and wages… and this happens because the justice department is all on the take and doesn't give a fuck about serving anyone or anything but themselves and their rich buddies.

To survive, I was forced to cannibalize my savings and retirement, the last of which was a small IRA. This came in a year with mammoth expenses and not a single dollar of income. I filed no return that year thinking that because I didn't have any income there was no need. The sleazy government decided that they disagreed. But they didn't notify me in time for me to launch a legal objection so when I attempted to get a protest filed with the court I was told I was no longer entitled to due process because the time to file ran out. Bend over for another $10,000 helping of justice.

So now we come to the present. After my experience with the CPA world, following the business crash I swore that I'd never enter another accountant's office again. But here I am with a new marriage and a boatload of undocumented income, not to mention an expensive new business asset, a piano, which I had no idea how to handle. After considerable thought I decided that it would be irresponsible NOT to get professional help; a very big mistake.

When we received the forms back I was very optimistic that they were in order. I had taken all of the years information to Bill Ross, and he came back with results very similar to what I was expecting. Except that he had neglected to include the contents of Sheryl's unreported income; $12,700 worth of it. To make matters worse, Ross knew all along this was missing and I didn't have a clue until he pointed it out in the middle of the audit. By that time it had become brutally evident that he was representing himself and not me.

This left me stuck in the middle of this disaster trying to defend transactions that have no relationship to anything tax-related (at least the tax-related transactions were poorly documented). Things I never knew anything about and things my wife had no clue would ever matter to anyone. The end result is… well, just look around.

I remember reading about the stock market crash before the "great" depression and how there were wealthy bankers and businessmen jumping out of windows when they realized they screwed up and lost everything. Isn't it ironic how far we've come in 60 years in this country that they now know how to fix that little economic problem; they just steal from the middle class (who doesn't have any say in it, elections are a joke) to cover their asses and it's "business-as-usual". Now when the wealthy fuck up, the poor get to die for the mistakes… isn't that a clever, tidy solution.

As government agencies go, the FAA is often justifiably referred to as a tombstone agency, though they are hardly alone. The recent presidential puppet GW Bush and his cronies in their eight years certainly reinforced for all of us that this criticism rings equally true for all of the government. Nothing changes unless there is a body count (unless it is in the interest of the wealthy sows at the government trough). In a government full of hypocrites from top to bottom, life is as cheap as their lies and their self-serving laws.

I know I'm hardly the first one to decide I have had all I can stand. It has always been a myth that people have stopped dying for their freedom in this country, and it isn't limited to the blacks, and poor immigrants. I know there have been countless before me and there are sure to be as many after. But I also know that by not adding my body to the count, I insure nothing will change. I choose to not keep looking over my shoulder at "big brother" while he strips my carcass, I choose not to ignore what is going on all around me, I choose not to pretend that business as usual won't continue; I have just had enough.

I can only hope that the numbers quickly get too big to be white washed and ignored that the American zombies wake up and revolt; it will take nothing less. I would only hope that by striking a nerve that stimulates the inevitable double standard, knee-jerk government reaction that results in more stupid draconian restrictions people wake up and begin to see the pompous political thugs and their mindless minions for what they are. Sadly, though I spent my entire life trying to believe it wasn't so, but violence not only is the answer, it is the only answer. The cruel joke is that the really big chunks of shit at the top have known this all along and have been laughing, at and using this awareness against, fools like me all along.

I saw it written once that the definition of insanity is repeating the same process over and over and expecting the outcome to suddenly be different. I am finally ready to stop this insanity. Well, Mr. Big Brother IRS man, let's try something different; take my pound of flesh and sleep well.

redemption ? or a feint ?

"Trading, proprietary or otherwise, did not lead to the financial crisis," said Rob Nichols, president of the Financial Services Forum, a lobbying group for CEOs of firms such as Goldman Sachs and JPMorgan Chase.

He said the government should be focused on better risk management, corporate governance and other forms of regulatory oversight, "rather than arbitrarily banning certain activities, or setting arbitrary size limits."

This guy Obama was living true to my prediction all of 2009 as an expert practitioner of masterly inactivity. But post the loss of a crucial and important senate seat in a recent election he has suddenly realised why he won the elections in the first place - TO CLEAR THE MESS THAT THE REPUBLICANS HAD MADE IN THE PAST CENTURY..

If this proposal of his to limit banks to banking and remove all proprietary trading to separate entities not backed by banks or institutions where public money is involved were to pass muster in congress - this man Obama will have my vote if ever he decides to move to India and stand for elections. (why not - we have no problems with an italian running the country!!).

As for Mr Rob Nichols and those whom he represents - they now have to think up another way to keep their casinos running with public funds!!

SATiAte

Is this a blooper from the Securities Appellate Tribunal (SAT) or things so corrupt in this country that any kind of verdict is up for sale?

Point of the case:
1. Are PE firms to be treated as promoters (as they have controlling rights on decision making) etc.?

SAT has ruled that in the case of Subhkam Ventures (I) Pvt. Ltd, that PE firms need not have to lose their affirmative rights as this would not amount to control and hence the tag of promoter would not attach to them.

What I fail to understand is that if some are first among equals as all will be shareholders, then for that purpose there is the possibility to issue differential voting rights stocks. The very fact that some shareholders have rights that normal shareholders do not and cannot exercise - those holding these rights should be made more accountable and their actions transparent. It would be easy for a competitor to mask his investments in a rival company and kill it by effectively using his affirmative acts to see that the rival is slow to react to his moves in the market.

This kind of trend is dangerous as L&T recently had a proposal in its Board to enter the field of Insurance. Its largest shareholder which is LIC has reportedly blocked the proposal as they fear the competition and the consequential loss of business. Where is no shareholder agreement if an LIC with one member on the board can flex its muscles one fears what these PE's would do if they were to be given this free hand with no accountability or transparency as to their holdings.

It would be interesting to see if SEBI were to appeal this. Would be interesting to know the lobbyists who got this victory for the PE investors.
